Insulation Terms and Conditions

CONDITIONS OF BUSINESS

1. INTERPRETATION

(a) In these conditions ëthe Companyí means Dyson Insulations Ltd. and ëthe Purchaserí means the person, firm or company who places an order with the

Company for the supply of work and materials ëthe worksí.

(b) These conditions shall govern and form part of every contract for the provision of the works by the Company. Any variation, cancellation of waiver of these

Conditions shall only be valid if made in writing and signed by the Managing Director of the Company.

2. QUOTATIONS

(a) All quotations are unless otherwise stated open for acceptance for a period of thirty days from the date thereof.

(b) Upon acceptance of a quotation by the Company, the Purchaser may be required to pay a deposit amounting to at least 10% of the total price (subject toa minimum of £20.00).

(c) If the contract is subsequently cancelled by the Purchaser prior to commencement, the full deposit will be forfeit to the Company.

(d) If the Company is prevented from carrying out the work within six months of placing the order, the order will be cancelled and the full deposit paid will beforfeit to the Company.

3. PAYMENT

(a) Payment of the final account shall become due immediately upon completion of the works.

(b) Payment of interim or stage accounts (which the Company reserves the right to deliver at its discretion) shall be made within seven days of delivery of theaccount by the Company to the Purchaser.

(c) Where part only of the contract is performed the Companyís standard rate of charge for the work actually carried out will apply.

(d) If notwithstanding prior agreement with the Purchaser as to date and time the Company is unable to gain access to the Purchaserís premises to executethe work a charge of £100 to cover the costs of the abortive visit shall be paid by the Purchaser.

(e) The Company reserves the right to charge interest on the balance outstanding on an account (whether final or interim) at a rate equivalent to 4% over

Yorkshire Bank plc base lending rate for the time being or such other lower rate as the Company may determine for the period from fourteen days after

delivery of the account until the date of the payment.

4. DEFECTS

(a) Sound materials suitable for the purpose will be used but are supplied subject to any Conditions of Sale attached thereto by the manu facturer or suppliers,

a copy of which will be made available to the Purchaser on request.

(b)

If the Purchaser alleges any defects in quality of the works he must do so in writing within six months from completion of this contract whereupon if theCompany shall accept that the works are defective it shall be entitled at its own cost to rectify the same and shall be under no further liability in respectthereof.

(c) If the Customer alleges any damage caused by the Companyís servants or agents in the course of performing the works he must do so in writing withinseven days from completion of this contract and in the event of the Purchaser failing to notify the Company within this period the liability of the Companyin respect of such damage shall be at an end.

5. PROGRESS OF CONTRACT

(a) The Purchaser agrees to permit access to the property for the Company, its servants and agents at all reasonable times so that the Company may carryout the work and any necessary inspections.

(b) The Company reserves the right to withdraw from the contract in whole or in part if close examination of the structure by the representatives of the Companysent to examine the structure or perform the work carried out at any time before the commencement of the contract, shows that in their opinion thestructure is unsuitable for insulation by the Companyís techniques of that safe access to any part of the structure is not possible using the equipmentnormally employed whereupon any deposit paid by the Purchaser will be refunded to him in full.

(c) The Purchaser shall make available to the Company the free facility of water, lighting and power installations and shall be responsible for all costs so

incurred.

6. GUARANTEE

Any guarantee given or offered by the Company in respect of the works will be valid only upon payment in full of the final account in respect of the works.

 

7. GENERAL

(a) Installation dates and delivery promises are made in good faith but the Company cannot be held responsible for any loss whatsoever arising from delay inthe commencement or completion of the works.

(b) The price quoted shall be inclusive of Value Added Tax which the Purchaser shall be liable to pay to the Company as is equal to the V.A.T. properlychargeable by H.M. Customs and Excise on the company under the law for the time being relating to V.A.T. in respect of the supply by the Company tothe Purchaser of the works included in this contract (or in any agreed variation thereof).

(c) The Purchaser warrants that he has authority to enter into this contract.

(d) Quotations for cavity wall insulation include for filling only external wall areas of entirely masonry constructions.

Area of tile hanging, weatherboarding and

non-masonry construction cannot be insulated and are not included in the price quoted.

(e) The Customer should note that it is not always possible to obtain a true colour match, particularly on rendered and painted walls.

8. DATA PROTECTION

DYSON INSULATIONS will use the information you provide for purposes connected with the installation of your insulation.

We are also required to send your details to the energy provider that funds your installation for quality assurance and regulatory

purposes. The energy provider concerned may provide these details to OFGEM, the regulator for gas and electricity if required to do so.
